Accountant in Bankruptcy

It is intended that those further parts of the Bankruptcy and Diligence etc. (Scotland) Act 2007 for which the Accountant in Bankruptcy has policy responsibility will be considered between April 2008 and April 2010. A provisional timeline for commencement has been published and can be viewed on this website. The timeline may be subject to change.

April 2009

Changes to diligence planned for April 2009 are:-

• Inhibition
• Arrestment in execution and action of furthcoming

June/ July 2009

The changes to diligence planned for June/ July 2009 are:-

• Attachment of money
• Actions for removing from heritable property
• Admirality actions and arrestments of ships

Autumn 2009 onwards

Part 4 of the Bankruptcy and Diligence etc. (Scotland) Act 2007 provides for the following:-

• Chapter 1 - the abolition of adjudication of debt
• Chapter 2 - the introduction of a new diligence known as Land Attachment
• Chapter 3 - the introduction of a new diligence known as Residual attachment

Section 208 of the Act abolishes the diligence of maills and duties

All 3 chapters of Part 4 and section 208 will be considered together. Work has started to look at these provisions and further information about commencement will be provided as soon as it is available.

April 2010

Changes to diligence planned for April 2010 are summarised here.

• Disclosure of information
