On 19 February 2008, the Scottish Parliament Justice Committee debated the draft of the Bankruptcy (Scotland) Act 1985 (Low Income, Low Asset Debtors etc) Regulations 2008. The Cabinet Secretary for Justice, Kenny MacAskill MSP spoke to the regulations before the Committee.

During the debate some concerns were raised by MSPs regarding several issues surrounding the introduction of the route into bankruptcy. In response to concerns, Mr MacAskill assured the Justice Committee that a review would be carried out after the scheme had been in operation for four months and again after one year.
