The new application pack replaces the previous version which is no longer valid and should no longer be used.

The Bankruptcy (Scotland) Amendment Regulations 2008 (SSI 2008/334) provide that existing forms can only be accepted up until 31 December 2008. From 1 January 2009 they cannot be accepted and the new Debtor Application Pack 1s must be used.

Why did we have to republish it?

The application pack has been updated following a change to the National Minimum Wage and the introduction of the Employment and Support Allowance in October 2008.

We have also taken the opportunity to review some of the questions on the form to ensure that the information supplied is accurate and relevant.

What are the amendments?

  • The national minimum wage has been updated.
  • Form 9 has been amended to request additional information
  • A statement alerting people to the consequences of bankruptcy has been added
  • A request for copies of Hire Purchase agreements has been added to the document checklist; and
  • The ethnicity questionnaire has been reformatted.
