Revocation of the Debt Arrangement Scheme (Scotland) Amendment Regulations 2009

The Minister for Community Safety, Fergus Ewing MSP has agreed to revoke the above regulations which would have come into force on 1 July 2009. These regulations will be revoked by the Scottish Government on 25 June 2009. As a result of this, no changes will be made to any of the current provisions relating to the Debt Arrangement Scheme.

The ongoing administrations of all Debt Payment Programmes (DPPs) will continue to be delivered by approved money advisers. The DAS administrator will also continue to receive applications for the approval, variation and revocation of DPPs using the existing provisions.

Cases in mid-process should be progressed using the existing route and creditors should continue to deal with the appropriate approved money adviser in all cases.

The Minister has expressed that he wishes to formally consult on DAS during the summer in order to consider opinions for future legislative change during next session of Parliament. Further information will be provided as soon as possible.

We aim to issue a consultation in mid-July in order to collate responses in September. These responses will feed into new draft legislation in Autumn 2009, leading to formal changes being introduced early in 2010. This is subject to ongoing discussions and Ministerial agreement.
