Creditor evidence when making a claim

If a bankrupt person (debtor) owes you money and you wish to submit a claim in the bankruptcy, you must send us a claim form (Form 4) together with documentary evidence showing the amount owed to you on the date the person went bankrupt. We will make a decision on whether to accept or reject the claim based on the information provided. This is known as the adjudication process.

If a debtor informs us or we have been notified that you are a creditor, we will automatically send you a claim form within 60 days of the award of the bankruptcy. If this is not returned to us we will send you another claim form (Form 4) at the end of the bankruptcy period when we are ready to pay a dividend. You have 21 days from the date on the letter to return the claim form and evidence of the debt. Cases awarded under the Low Income Low Asset (LILA) route should not by definition pay out a dividend, therefore there is no requirement to send a claim form or proof of debt. If however, circumstances change and a LILA case converts to full administration (where contributions will be taken from the debtor, to pay creditors) you will be invited to submit a claim form and provide proof of debt.

When completing the claim form please ensure all sections are fully completed as incomplete forms will result in your claim being rejected. When returning the claim form please enclose documentary evidence to support your claim. Any claim not supported by documentary evidence will be rejected. The types of evidence we accept include:

  • Invoices
  • Statements
  • Court decrees
  • Charge for payment
  • Computer data prints
  • A loan to family members/friends must be supported by a document notarised by a solicitor

Please ensure that the evidence shows the amount owed prior to or as at the date of bankruptcy. If the documentary evidence is dated later than the date of bankruptcy your claim could be rejected.

We will send you a reminder at the end of the 21 day period giving you a further 14 days to supply us with the information we need. If you fail to respond within this time, we will complete the adjudication process and your claim will be rejected.

**Please note that if the trustee in a bankruptcy case is not AiB, you should contact the trustee direct to submit a claim.
