Q10. How long will my bankruptcy last?

You are normally discharged from bankruptcy after one year. However your discharge may be delayed if you do not co-operate with your trustee.  The bankruptcy case may last longer than the period that you personally are bankrupt; this is because your trustee remains in office until they have completed the administration of your estate.
 
It is important to note that if you do not behave appropriately before or during your bankruptcy, your trustee can ask the courts to put restrictions upon your activities after you have been discharged. These restrictions can last between 2 and 15 years, depending on the seriousness of your actions. 
 
If you were made bankrupt before 1 April 2008, the legislation under which you were made bankrupt may be different. Contact your trustee or AiB.
