Q13. How long will my bankruptcy last? (If bankrupt after 1 April 2008)
You are generally discharged from bankruptcy after one year. Your discharge can be delayed for periods of 2 years at a time if you do not co-operate with your trustee. Your trustee remains in office for as long as it takes to finalise the administration of your estate so your bankruptcy case may last for longer than the period that you personally are bankrupt.
You must also be aware that if you act inappropriately with regards to your income, assets and conduct, either prior to, or during your bankruptcy, your trustee can ask the courts to put restrictions on your future activities after you have been discharged from your bankruptcy. These restrictions can apply for between 2 and 15 years, depending on the severity of your inappropriate conduct.
