Q13. I have received a Warrant to Cite. What is this?

A Warrant to Cite is an order granted by the court notifying you that one or more of your creditors is attempting to make you bankrupt.  The Warrant to Cite will advise you of the date a court hearing has been set at which you will have the opportunity to attend and explain why you should not be made bankrupt. 

If you receive a Warrant to Cite you should seek advice from a money adviser at your local Citizens Advice Bureau, Money Advice Centre or Trading Standards office about possible ways to deal with your debt, before the court date for the bankruptcy hearing.

If you fail to appear at court or do not give a reason why you should not be made bankrupt, then sequestration (bankruptcy) will be awarded.  The award of bankruptcy will be effective from the date the Warrant to Cite is granted.

The creditor must send you a Debt Advice and Information Pack, before they petition for your bankruptcy. If you have not received this, you should inform the Court.
