Q26. Who will be my trustee?

If you apply for your own bankruptcy, unless you nominate an insolvency practitioner to be your trustee, the Accountant in Bankruptcy will be appointed. If you wish to nominate an insolvency practitioner, you must their formal written agreement to act as your trustee, before the Accountant in Bankruptcy will appoint them.

If a creditor petitions the Sheriff Court for your bankruptcy, the creditor can nominate an insolvency practitioner to be your trustee. Again, the insolvency practitioner must agree to act. If no insolvency practitioner is nominated, nor agrees to be trustee, the court will appoint the Accountant in Bankruptcy as your trustee.
