Mental Health Moratorium consultation

The Scottish Government has published the Mental Health Moratorium Regulations consultation report, summarising the responses to the consultation on the draft Regulations for the Mental Health Moratorium.

The moratorium will protect people with serious mental health problems from debt recovery action by creditors. An enabling power to establish such a moratorium is included in the Bankruptcy and Diligence (Scotland) Act 2024.

From the consultation responses there is majority support for most of the proposed provisions for the moratorium. However, given that some areas may require further consideration before formally laying the regulations in Parliament, additional engagement with stakeholders is continuing to further support the development of draft Regulations for the Mental Health Moratorium.
