Scenario

The creditor asked for a review of AiB’s decision to direct the trustee to market and sell the debtor’s property. The creditor claimed that the charges put against the property by the local council were invalid and the trustee should be taking action to show that this was the case. The trustee confirmed that they had obtained legal advice which confirmed that the council charges were valid and the cost of challenging that opinion through the courts would far outweigh any benefit to creditors.

Decision

The reviewing officer confirmed the trustee’s original decision, and the direction was approved.
